These Terms of Service ("Terms") govern your use of yellowbook.site and the website-as-a-service ("WaaS") platform operated by yellowbook ("we", "us", or "our"). By accessing yellowbook.site, requesting a demo, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use our service.
1. The Service
yellowbook creates a business landing page for your business using publicly available information (e.g. Google Maps, Facebook, Instagram, and similar platforms) and hosts it at a subdirectory of yellowbook.site (e.g., yellowbook.site/your-business/). A subscription covers:
- —A business landing page hosted on yellowbook.site, built and maintained by yellowbook.
- —Your listing in the yellowbook.site business directory.
- —Content updates as specified in your selected plan (hours, menu, photos) upon written request.
- —Ongoing Cloudflare hosting and SSL certificate.
2. Subscription & Payment
- —The subscription fee is as stated at checkout, payable in advance via the payment method(s) offered at time of purchase.
- —Subscriptions renew at the end of each billing period. We will contact you at least 30 days before your renewal date. If payment is not received within 14 days of the renewal date, your page will be taken offline.
- —Fees are quoted in the currency shown at checkout and may be inclusive of applicable taxes as required by local law.
- —Fees are non-refundable once your site has been generated and delivered, except as required by applicable consumer protection law.
3. Content & Accuracy
- —We populate your site using publicly available data. We make reasonable efforts to ensure accuracy but cannot guarantee that sourced information (prices, hours, photos) is current at the time of publication.
- —You are responsible for notifying us of any inaccurate content by emailing hello@yellowbook.site. We will correct verified inaccuracies within 7 business days.
- —You warrant that you have the legal right to have your publicly available business information displayed on yellowbook.site, and that doing so does not violate any applicable law or third-party rights.
- —We reserve the right to decline or remove any listing that promotes illegal activity, contains prohibited content, or violates the rights of any third party.
4. Intellectual Property
- —The yellowbook brand, platform design, and site templates are owned by yellowbook and may not be copied or reproduced without written permission.
- —Photos, reviews, and text sourced from third-party platforms remain the property of their respective owners. We display this content under fair use principles for business information purposes.
- —Your business name, logo, and brand identity remain your property. By subscribing, you grant yellowbook a non-exclusive, worldwide licence to display your brand assets on yellowbook.site for the duration of your subscription.
5. Data Retention & Marketing Use
- —We retain the information you provide (business name, contact details, demo URL, and any content submitted through our forms) for as long as your subscription is active and for a reasonable period thereafter, in accordance with our Privacy Policy.
- —After your subscription ends, we may retain anonymised or aggregated data derived from your listing for platform analytics and service improvement.
- —By using our service, you grant yellowbook the right to feature your business — including your business name, logo, website screenshots, and general description — in yellowbook's marketing materials, case studies, social media, and promotional campaigns. We will represent your business accurately and professionally.
- —You may opt out of marketing use at any time by emailing hello@yellowbook.site. Opting out does not affect your subscription or listing.
6. Uptime & Service Levels
yellowbook.site is hosted on Cloudflare Pages, which targets 99.9% monthly uptime. We do not guarantee uninterrupted availability and are not liable for downtime caused by Cloudflare, force majeure, or circumstances outside our control. Planned maintenance will be communicated at least 24 hours in advance wherever possible.
7. Limitation of Liability
To the maximum extent permitted by applicable law, yellowbook's total liability to you for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or lost customers, arising from your use of the service or any temporary unavailability of your listing.
8. Cancellation & Takedown
- —By you: You may cancel your subscription at any time by emailing us. Your page will remain online until the end of your paid period, then be removed within 30 days. No pro-rata refunds are issued.
- —By us: We may suspend or remove your listing immediately if you breach these Terms, fail to pay, or if continuing to host your content would expose us to legal liability. We will notify you by email.
- —Content export: Upon cancellation you may request a copy of your site's HTML file within 30 days of takedown, free of charge.
9. Governing Law
These Terms are governed by applicable law. We will always seek to resolve disputes amicably first. If a dispute cannot be resolved informally, the parties agree to submit to the jurisdiction of a mutually agreed court or arbitration body. If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
10. Changes to These Terms
We may update these Terms as our service evolves. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of yellowbook.site after changes take effect constitutes acceptance of the updated Terms.
